Terms and Conditions of Service

AutoStar Transport Express strives to be transparent with our clients. Please read carefully the terms and conditions of service below, which govern all transactions between AutoStar Transport Express and you, the Customer. If you have any questions, do not hesitate to call us toll-free to speak with one of our professional car shipping Transport Coordinators.

By requesting and retaining the transport services of AutoStar Transport Express LLC, the Customer acknowledges its agreement to the following terms and conditions of service:

  1. AutoStar Transport Express is a property broker retained by the Customer to make transportation arrangements with a Carrier on the Customer’s behalf. Customer fully understands that by allowing the carrier to pick up the Customer’s vehicle(s), Customer shall be bound by the terms and conditions contained in the Carrier’s bill of lading. When a Carrier is assigned, AutoStar Transport Express will provide the Carrier’s information and pertinent documents to the Customer via email. This will include the name and contact information of the Carrier and in select cases, the carrier’s insurance card and picture ID of the assigned driver. It is the Customer’s sole responsibility to share the Carrier information and all provided documents with their pickup contact. It is also the pickup contact’s sole responsibility to verify and only release the vehicle(s) to the assigned Carrier exhibited in the shared documents and who is in possession of a dispatch sheet provided by AutoStar Transport Express, clearly stating the name of the Carrier on-site to conduct the transport. If the vehicle(s) is released by the pickup contact to another Carrier not assigned by us, or if the pickup contact fails to correctly verify and identify the Carrier prior to release, AutoStar Transport Express will not be held liable for theft, damage, or additional charges.
  2. The customer further acknowledges having ample time and opportunity to read this agreement prior to entering into same and the customer understands fully the terms and provisions of the agreement and has voluntarily entered into same.
  3. Customer may not unilaterally change any term or condition of this agreement without the express written consent of AutoStar Transport Express LLC. AutoStar Transport Express LLC expressly rejects any other terms and conditions that have not been expressly agreed to in writing by an authorized representative of AutoStar Transport Express.
  4. AutoStar Transport Express LLC agrees to arrange for the transportation of the vehicle(s) described on the quotation, to be carried on or about the requested dates. AutoStar Transport Express LLC will designate a Carrier to perform the carriage of the vehicle(s) from origin to destination. There are absolutely no guarantees regarding pickup or delivery times and dates. Neither AutoStar Transport Express nor the Carrier shall be held responsible for loss or damages occasioned by delays of any kind or for any reason, car rental fees, or any accommodation fees. Neither AutoStar Transport Express nor the Carrier shall be held liable for the failure of mechanical, electrical, or operating parts of Customer’s vehicle(s).
  5. AutoStar Transport Express LLC agrees to make arrangements for the shipment of the described vehicle(s). The Customer acknowledges and understands that ample notice of intent to ship is a primary contingency factor. The Customer also acknowledges and understands that any shipment, regardless of the type of trucking, may be delayed due to adverse weather or road conditions, illness, mechanical breakdown of trucks, supply and demand for trucks and drivers, hours of operation, etc. If consequently, the Carrier cancels, AutoStar Transport Express LLC has the right to arrange for another carrier for a period of 3 (three) additional days. IN ABSOLUTELY NO CASE WILL AutoStar Transport Express LLC BE RESPONSIBLE FOR OR REIMBURSE TOLLS & CAR RENTAL EXPENSE.
  6. The Customer’s relationship with the carrier is subject to all of the terms and conditions of the Carriers’ straight bills of lading, copies of which are available at the office of the Carrier.
  7. The carrier’s responsibility begins when the Customer or its agent or representative releases the vehicle(s) to the Carrier at the origin and terminates when the Carrier delivers the vehicle(s) at the destination. AutoStar Transport Express LLC must be notified should the Customer be unavailable for pickup or delivery so that alternative arrangements can be made. If a carrier is assigned and the vehicle cannot be picked up for any reason, there will be an additional $200.00 charged to the Customer’s credit card. This charge will be applied to rescheduling and/or dry-run fees of the carrier. Postponing the transport of a vehicle must be done by the Customer no less than 10 business days prior to the first available pickup date. If a carrier has already been assigned, normal rescheduling fees will apply. If the Customer decides to postpone the pickup dates of their vehicle(s) beyond 14 days from the original dates, the price of the transport is subject to change based on current rates for the rescheduled dates.
  8. AutoStar Transport Express LLC hereby notifies Customer that their vehicle will be driven on and off the carrier, or to and from the carrier at the pickup or delivery site. Should the carrier be unable to access either site, the Customer or consignee shall make a reasonable effort to meet the truck at a suitable location. If a vehicle is NOT operational and/or the carrier cannot physically reach the location, a local tow truck may be used to deliver the vehicle to the assigned carrier at the expense of the Customer.
  9. All vehicles delivered by an authorized carrier with an outstanding balance must be paid for using cash, money order, or cashier’s check (U.S. funds only). Acceptance of electronic payment methods is at the sole discretion of the carrier. Should delivery be attempted after attempted notification (3 to 24 hours voice notification to phone numbers provided by Customer) and Customer or his agent does not have proper funds or is unavailable to receive delivery, vehicle(s) may be taken to and left at the nearest terminal at the discretion of the carrier, where Customer will have to retrieve and pay for storage or redelivery fees. In the event the Customer decides to arrange to make full payment with a credit card at the time of the booking, the order will be subject to a 5% service charge. Acceptance of other forms of electronic payment, including cash apps for the balance due, is solely at the carrier’s discretion.
  10. AutoStar Transport Express LLC does not guarantee transport by any specific driver/carrier.
  11. If Customer is shipping an inoperable vehicle, Customer is responsible for fully disclosing the condition of the vehicle and that it is inoperable. Customer may be required to help load and unload said vehicle at the discretion of the driver. Should vehicle(s) become inoperable during transport, $200.00 will be due at the time of delivery in addition to any other money owed. It is the Customer’s responsibility to make sure the vehicle is in proper working order. INOPERABLE VEHICLES MUST BE ABLE TO ROLL, STEER AND BRAKE. If the inoperable vehicle does not meet any one of these three conditions, additional fees may apply. If a vehicle is INOPERABLE and the carrier cannot physically reach the location, a local tow truck may be used to deliver the vehicle to the assigned carrier at the expense of the Customer.
  12. Carriers arranged by AutoStar Transport Express LLC will not knowingly transport vehicles with personal or household items in the passenger or trunk compartment. Federal regulation prohibits the carriage of such items. If such items are contained in the vehicle at the time of pick up by the carrier, such items become the sole responsibility of the Customer and additional fees may apply depending on the weight of the items and are left solely to the discretion of the carrier assigned.
  13. AutoStar Transport Express LLC, its agents, officers, directors, and Carriers arranged by AutoStar Transport Express will not be responsible for damages arising from vandalism, theft, riots, strikes, political unrest, acts of terrorism, acts of God (including but not limited to fire, flooding, hail, sandstorm, tornadoes, and earthquakes) or objects flying from the road or sky during transport. Customer and other interested parties should maintain their own insurance covering the vehicle(s) during shipment.
  14. The Customer is responsible for preparing the vehicle(s) for transport: all loose parts, fragile or protruding accessories, low-hanging spoilers, fog lights, antennas, etc., must be removed and/or properly secured. Any part that falls off in transit is the Customer’s responsibility, including damages done by said part to any and all vehicles involved. This includes maritime preparations of the vehicle in compliance with the requirements set forth by the ocean transporter and provided to the customer at the time of booking.
  15. If damage should occur, all money owed for transport must be paid to initiate a claim. Damage must be noted in the proper place on the bill of lading and signed by the driver and Customer or consignee regardless of weather, or time of day. Signing the bill of lading without any notation of damage verifies that the Customer or consignee has received the said vehicle in good condition and that AutoStar Transport Express LLC and the Carrier are relieved of any further responsibility. The customer or consignee MUST check the vehicle thoroughly. ***Please see line item #31 for a list of exclusions.
  16. AutoStar Transport Express LLC and the Carrier must also be notified of any damage by phone within 24 hours. The customer must submit in writing a description of the damage, clear pictures, and 2 estimates within 10 days of receipt of the said vehicle directly to the designated carrier for any resolution to be initiated. AutoStar Transport Express LLC will support you in this effort should such a problem occur, but in no way will AutoStar Transport Express LLC accept responsibility for any negligence of the assigned carrier. If the vehicle is valued at a higher than the market rate, it is suggested that the Customer purchase a special insurance rider. Customer is hereby informed and understands that claims against motor Carriers are governed by federal law, the Carmack Amendment to the ICC Termination Act of 1995, 49 U.S.C. §14706, and claims against ocean Carriers are typically governed by the Carriage of Goods by Sea Act, 46 U.S.C. §30701. The customer is urged to seek independent legal advice (at the Customer’s sole expense) on these laws in the event of a claim.
  17. Customer agrees to pay AutoStar Transport Express in full the fees for Services and any additional charges that may be incurred in accordance with this Agreement. The fees for services with the terms and conditions will be set forth in electronic format and made available to the Customer upon submitting their order. The customer understands that at their request AutoStar Transport Express can offer 2 payment options:
    Option 1: Customer has the option of booking an order using a 1-payment format, requiring a single upfront payment for the total tariff (“First Payment”) for AutoStar Transport Express to collect their service fee and the carrier’s fee. 1-payment format may have additional service fees including a 5% service fee on all credit card payments. For information on other accepted payment methods and fees, please consult with your AutoStar Transport Express agent.
    Option 2: The total fee is due in two installments, the first to be charged when AutoStar Transport Express receives the electronic signature from the customer agreeing to the initial installment (“First Payment”) and/or AutoStar Transport Express designates a carrier to transport Customer Vehicle. The second installment (“Payment due”) customer will issue to the designated carrier when the vehicle is delivered. The customer understands that changes in the distribution of funds or a breakdown in the 2-installment format may apply, resulting in additional charges to the customer’s credit card. In this scenario, the Customer will be contacted and advised. If the Customer is unreachable, the additional charges will be applied to the credit card on file and deducted from the payment due at delivery. All maritime-related transports need to be paid in full before the transport process can begin.
  18. The customer understands and accepts that there is no guaranteed pickup or delivery dates.
  19. The customer understands that the first available release date is NOT a guaranteed appointment date.
  20. The customer understands that AutoStar Transport Express is allotted 5 days FROM the first available release date to locate and assign a carrier for transport.
  21. Refund/Cancellation Policy/MONEY BACK GUARANTEE: If AutoStar Transport Express is unable to confirm a carrier within five (5) days from the first available date, Customer has the option of keeping the order open or canceling for a FULL refund of the deposit. If the order is canceled before the first available pick-up date or before the end of the fifth day for any reason, the deposit is not refundable. AutoStar Transport Express’ services are considered rendered when a carrier is assigned to an order, including but not limited to, assigning a maritime booking confirmation number for maritime transportation. Refunds will be processed only to the original payment method within 48 business hours of the cancellation request. Cancellation of an order must be submitted in writing via email sent to customerservice@autostartransport.com. AutoStar Transport Express does not accept, or honor cancellations made via phone call. Once a carrier has been assigned (dispatched) to a shipping order, AutoStar Transport Express notifies Customer via email (to the email address provided at service booking). If the Customer decides to cancel the shipping order after a carrier has been dispatched, the deposit will be kept as our services have been rendered. Any remaining balance will be refunded in full.
  22. Governing Law; Consent to Jurisdiction and Venue. These terms and conditions of service and the relationship of the AutoStar Transport Express and Customer shall be construed according to the laws of the State of Florida without giving consideration to principals of conflict of law.
    The customer agrees and consents as follows:
    (a) irrevocably consents to the jurisdiction of the United States District Court and the State courts in Palm Beach County Florida;
    (b) Agrees that any action relating to the services performed by AutoStar Transport Express, shall only be brought in said courts;
    (c) Consents to the exercise of personal jurisdiction by said courts over it, and
    (d) Agrees that any action to enforce a judgment may be instituted in any jurisdiction.
  23. AutoStar Transport Express LLC can only be liable for up to the amount of the deposit located on the Customer’s quotation. In no case can AutoStar Transport Express LLC be held liable for the designated carrier’s damage. AutoStar Transport Express LLC will provide carrier’s insurance certificates and carrier information should any controversy arise. The total cumulative liability of AutoStar Transport Express LLC for any and all claims and damages, whether arising from statute, contract, tort, or otherwise, shall not under any circumstances exceed the total fees paid by Customer to AutoStar Transport Express LLC for AutoStar Transport Express LLC services under the respective Order Confirmation. UNDER NO CIRCUMSTANCES WILL AUTOSTAR TRANSPORT EXPRESS LLC BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO A SHIPMENT OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  24. AutoStar Transport Express LLC works diligently to ensure Customers receive the best price and service. Simultaneously booking your vehicle for transport with AutoStar Transport Express LLC and other auto transport companies undermines the service we can provide as Carriers will opt for the higher priced transport. In the event that AutoStar Transport Express LLC fails to procure a carrier for your vehicle as a result of multiple transport bookings, the Customer Deposit is Forfeited AND YOUR ORDER WILL BE AUTOMATICALLY CANCELLED.
  25. AutoStar Transport Express LLC is a licensed and bonded Property Broker. We are responsible for booking the shipment of cars with a licensed and insured Motor Carrier Corporation, which handles its own damage claims. It may take a few weeks to process your claim since the drivers must return to their terminals with the original Bill of Lading and condition reports.
  26. AutoStar Transport Express LLC will not be responsible for demurrage at any Port Facilities. For Hawaiian / Alaskan /U.S. Virgin Islander and Puerto Rican transports, payment for the sea portion MUST be issued by the shipper BEFORE the vehicle arrives at the port. Once an order is received, a booking number will be provided to the shipper with instructions for issuing payment. Failure to do so may cause delays and/or additional storage fees. All shipments to or from Hawaii – vehicles MUST be FULLY operational with a working emergency brake or will be refused for shipment by the port agent. If the vehicle is refused by the port agent, the shipper will be responsible for all storage and/or redelivery fees of the vehicle.
  27. By either submitting your order online, sending us your order by fax, or by email, AutoStar Transport Express LLC understands you are placing your order and accepts the terms and conditions contained herein, which are also available on the AutoStar Transport Express website.
  28. Customers must make their vehicle available during transport time; if the vehicle becomes unavailable at any time after the order has been placed and a carrier has been assigned, AutoStar Transport Express LLC holds the right to cancel the order with no refund.
  29. The quoted price for transport is based upon the shipper’s FULL DISCLOSURE of the type of vehicle transported. Failure to identify modifications to the vehicle or the true dimensions of the vehicle (included by not limited to regular cab, crew cab, long bed, short bed, diesel, 4X4, flip-top conversion vans, extended length cargo vans, over-size (non-stock) tires or rims, lift kits, ground effects, modifications affecting ground clearance, ladder/roof racks, toolboxes, etc.) may result in additional fees. If a carrier is assigned and is unable to load the vehicle due to non-disclosure of information by the shipper, AutoStar Transport Express LLC reserves the right to cancel the order with no refund.
  30. The customer agrees that AutoStar Transport Express LLC has the right to reject (cancel) any order for any reason at any time.
  31. Neither AutoStar Transport Express LLC nor the Carrier shall be responsible for the following:
    • Damage to any mechanical components, including but not limited to engine, transmission, undercarriage, exhaust system, suspension, wheel bearing, tie downs, brakes, alignment, tuning, charging system or battery.
    • Damage was not detected at the pickup location due to poor weather or lighting conditions.
    • Loss of or damage to audio or video equipment not installed at the factory, including an antenna that does not retract to within 3 inches of the vehicle body.
    • Damage or fines incurred because the shipper left personal or household items in the vehicle.
    • Damage caused by fluids or objects flying up from the roadway, or out of the sky.
    • Damage to cloth or vinyl convertible or decorative tops over 2 years old.
    • Damage to T-tops, boots, bras, caps, or any other type of canvas covering.
    • Damages to vehicle interior including all upholsteries and peripherals.
    • Damage caused by leaking fluids, such as battery acid, motor oil, transmission fluid, brake fluid, power steering fluid, radiator coolant, or fallout resulting from an act or acts of God.
    • Damage caused by freezing of cooling system and/or battery.
    • Damage caused by failure of factory tie-downs or pull-through from tie-down holes.
    • Damage to, or caused by any vehicle, that cannot be driven on or off the transport under its own power (Vehicle will not run or has no braking system).
  32. Customer agrees to indemnify, defend and hold AutoStar Transport Express LLC and their employees, officers and directors harmless from and against any and all losses, liabilities, damages, payments, settlements, judgments, fraud, penalties, fines, expenses, (including attorneys’ fees), and costs, suits, actions and claims (whether actual, potential, threatened or pending), brought by any person or entity, including damages for injury or death of persons and/or damage to property, including real property and/or the environment, claim liability and damages, arising from the acts or omissions of Customer, its agents, employees or representatives.
  33. Fraud and Third-Party Impersonation: AutoStar Transport Express (the “Company”) is not responsible for any losses, damages, or fraudulent activity resulting from third parties impersonating the Company, its employees, or its agents. The Company will never request payments via Western Union, MoneyGram, cryptocurrency, or untraceable wire transfers. All official transactions and communications are conducted exclusively through our verified corporate domains and authorized payment gateways. The User acknowledges that they are responsible for verifying the authenticity of any communication or payment request. The Company shall not be held liable for any funds sent to unauthorized third parties or for any breach of the User’s personal data occurring through external phishing, “spoofing,” or other fraudulent schemes outside of the Company’s direct control.

INTERNATIONAL/MARITIME SHIPMENTS:
Due to constantly changing laws, regulations, and customs requirements in port countries, it is the Customer’s responsibility to verify any and all fees applicable to the pickup and receipt of their vehicle(s). AutoStar Transport Express LLC and the Carrier shall not be responsible or liable for any changes in legislation, laws, or regulations that result in additional fees. Quote Prices are subject to change. Unless otherwise noted, all ocean freight quotations are valid for 30 days from the date of the original quotation, subject to equipment availability, and any and all tariffs at the time of shipment. Inland freight quotations are subject to third-party increases valid at the time of shipment, subject to any fuel increases, seasonal increases, national rules, and regulations of the country(ies) of transit, subject to availability of inland carrier at the time of booking. Loading, lashing, securing, blocking, and bracing of cargo is for the shipper’s account. The Carrier reserves the right to stow cargo in the best interest of the Vessel and in compliance with local, national, and international rules, regulations, and conventions. On-deck shipments at the shipper’s risk. Dangerous cargo, as defined by 49 CFR or the IMDG Code, is subject to the Carrier’s approval at the time of booking. Kindly note all vessel dates are subject to changes. Equipment is subject to availability. The customer is responsible for ALL incurred charges, including but not limited to customs, port charges, storage fees, changes in regulation requirements, etc. At the request of U.S. port authorities, AutoStar may solicit personal information from customers, including Employer Identification Numbers (EINs) and Social Security Numbers (SSNs). This information is necessary to complete various documentation and process bookings with maritime providers. AutoStar is committed to handling this information with the utmost care and confidentiality. However, it is important to note that AutoStar shall not be held liable for any misuse of this information that occurs outside of our control.

U.S. and International shipping ports:
All quotes provided by AutoStar Transport Express do not include port and/or escort fees. Customers dropping off or picking up vehicles at any port domestic or international are responsible for gathering the necessary information on the requirements to enter the port and any applicable fees required at the time of entry. AutoStar Transport Express is not responsible for any delays for drop-off or pickup at these ports due to the customer’s lack of knowledge of the port entry requirements or for any payment or reimbursement of any escort fees. AutoStar Transport Express is not responsible for delays by maritime freight forwarders as these delays are out of our control due to factors such as weather, natural disasters, protests, acts of terrorism, national emergencies, mechanical issues, or inspections by U.S Customs.
